Under current Vietnamese law, foreigners may apply for a Vietnamese Criminal Record Certificate if they fall into one of the following categories:
They are currently residing legally in Vietnam; or
They previously resided legally in Vietnam but have already departed and now require a Criminal Record Certificate for legal or administrative procedures overseas.

However, the procedure differs depending on whether you require Criminal Record Certificate No. 1 or Criminal Record Certificate No. 2.
Foreign applicants may authorize another person in Vietnam to submit the application and collect Criminal Record Certificate No. 1 on their behalf, provided the authorization complies with Vietnamese law.
If the authorized representative is the applicant's parent, spouse, or child, a written Power of Attorney may not be required in certain cases. However, documentary proof of the family relationship must be provided, and such documents must have been issued by a competent Vietnamese authority.
For all other authorized representatives, a valid Power of Attorney is required. The Power of Attorney must be issued or certified by:
A competent authority in Vietnam; or
A Vietnamese diplomatic mission or consular office overseas.
This is the most common option for applicants who are unable to return to Vietnam.
Under current Vietnamese law, Criminal Record Certificate No. 2 cannot be applied for through an authorized representative, except where the applicant is a minor and the application is submitted by his or her parent or legal guardian.
